Citizens of the Russian Federation are entitled to free medical care in accordance with Part 1 of Article 41 of the Constitution of the Russian Federation. This right is exercised through the Program of State Guarantees for the Provision of Free Medical Assistance to Citizens of the Russian Federation (hereinafter - the Program of State Guarantees). This program is approved annually by the Government of the Russian Federation.
The territorial program of state guarantees of free medical assistance to citizens in the city of Moscow for 2015 and for the planning period of 2016 and 2017 (hereinafter - the Program) establishes a list of types, forms and conditions of free medical care, a list of diseases and conditions, provision of medical assistance with which is free of charge, categories of citizens whose medical care is provided for free, average standards of the volume of medical care, average standards of financial costs per unit the source of the volume of medical care, average per capita funding standards, the procedure and structure for setting tariffs for medical care and methods of paying for it, as well as the procedure, conditions for the provision of medical care, criteria for the availability and quality of medical care provided to citizens of the Russian Federation.
Within the framework of the State Guarantees Program, free of charge are provided:
- primary health care
- ambulance, including specialized
- specialized
In accordance with the State Guarantees Program, the constituent entities of the Russian Federation approve territorial programs of state guarantees for the provision of free medical care to citizens of the Russian Federation (hereinafter - territorial programs of state guarantees), which include territorial programs of compulsory medical insurance.
A citizen of the Russian Federation has the right to familiarize himself with the contents of the territorial program of state guarantees at a healthcare institution, medical insurance organization, healthcare management body or territorial fund of compulsory medical insurance of a subject of the Russian Federation.
Territorial state guarantee programs include a list of diseases and types of medical care provided to citizens free of charge from the consolidated budget of the subject of the Russian Federation and funds of the territorial fund of compulsory medical insurance, as well as lists of vital and essential medicines and medical devices appointments necessary for emergency, emergency and inpatient care.
In addition, the territorial programs of state guarantees determine the conditions for the provision of medical care, including the waiting time for medical care provided in a planned manner, the procedure for exercising the right to provide extraordinary medical care to certain categories of citizens in healthcare facilities of the subject of the Russian Federation and municipalities. < br /> When providing medical care in a hospital setting, as well as emergency and emergency medical assistance to citizens free of charge providing vital medicines and medical devices are in accordance with established territorial programs.
When providing medical care on an outpatient basis, certain categories of citizens are provided with necessary medicines and medical supplies that are dispensed by doctors for free or at a 50 percent discount on free prices (the list of categories of citizens is determined by the subject of the Russian Federation).
Paid medical services to the population may be provided by state and municipal healthcare institutions in accordance with the civil legislation
Violations of the rights of citizens to receive free medical care are considered:
- illegal collection by doctors and paramedical personnel of medical organizations of funds for the provision of medical care (provision of services), provided for by the State Guarantees Program;
- illegal collection cash to the cash desk of medical organizations for the provision of medical care (provision of services) under the State Guarantees Program;
- collection of cash for e paid medical services that are not provided for by the State Guarantees Program, for the implementation of which the medical organization does not have special permission of the relevant health management body
- illegal collection of funds for issuing treatment directions, vacation recipes medicines;
- purchase of medicines and medical devices at the expense of patients from the list of vital signs approved by the territorial program of state guarantees on the necessary medicines and medical devices;
- failure to comply with the terms for the provision of planned medical care established by the territorial program of state guarantees.
In case of violation of the rights of citizens to receive free medical care in accordance with the legislation of
- to the head of the healthcare institution;
- to insurance medical organization (in insured cases).
If you are not satisfied with the results of the review, you can contact the appropriate healthcare management body (municipality, constituent entity of the Russian Federation) under the subordination of the healthcare institution, as well as the territorial funds of compulsory medical insurance or the territorial bodies of the Federal Service for Supervision of Health and social development. In cases of violation of citizens' rights to receive free medical care in Federal state healthcare institutions, a citizen has the right to immediately contact the Federal Service for Supervision of Health and Social Development, as well as the Ministry of Health Russian Federation.
